California Man Developed Cancer From Baby Powder: J&J Told To Pay $18.8mn
Emory Hernandez Valadez, a man from California, filed suit in the California State Court against Johnson & Johnson?s seeking monetary charges. According to information, he has developed cancer with his exposure to Johnson & Johnson?s baby powder.
This was a major setback for the company as it seeks to settle many similar cases in relation to its talc-based products. The California State Court jury decided that the company must pay $18.8 million to the man.
Hernandez Valadex (aged 24) filed suit against Johnson & Johnson last year. He said that he had developed a deadly cancer named mesothelioma, The cancer developed in a tissue around his heart. He also said that he has exposure to the company?s talc since childhood.
According to Reuters.com,
?The jury found that Hernandez was entitled to damages to compensate him for his medical bills and pain and suffering, but declined to award punitive damages against the company. Hernandez will not be able to collect the judgment in the foreseeable future, thanks to a bankruptcy court order freezing most litigation over J&J’s talc.?
Erik Haas, the vice president of Johnson & Johnson, stated that the company is looking to appeal the verdict. According to him, the verdict is
?irreconcilable with the decades of independent scientific evaluations confirming Johnson’s Baby Powder is safe, does not contain asbestos and does not cause cancer.?
The cancer that Hernandez Valadex developed is a rare form, which makes his case different from the ones that are pending against Johnson & Johnson. Many other plaintiffs have sued the company, alleging that the baby powder and other talcum products contain asbestos, which is a major cause of the occurrence of mesothelioma and ovarian cancer in many.
